General Credit Rules – Mauritius
There are some general laws defined under “The Macro-Prudential Rules and Guidelines” that apply to all local commercial Banks in respect of the debt to income ratio as well as maximum loan to value ratio that needs to abide by. Working from there, depending on how the credit dossier is set up with regards to the Borrower’s proposed guarantees, each Bank then applies its own terms. Indicatively the debt to income ratio is calculated based on the monthly net revenue derived against all credit/loan repayments – the maximum allowable ratio is 50% for borrowers earning >5000€/month.

  Early Repayment
Penalties for Early Repayment: Yes, unless if the repayment is being effected from own generated cash flow/funds, then the early repayment fee shall be waived
Early Repayment Conditions: Any prepayment must amount to a minimum of 10% of the remaining balance of the loan

  BCP Bank’s standard terms
Coming on the Banking process now, please find hereunder an indication of the terms that will be related to the loan creation working on an assumption that loan type is housing loan with a local mortgage inscribed by Bank on the property to be purchased.
(i)      1st Rank Fixed Charge  MUR 51,400 – to register the bank lien on the property. Where the lien is above MUR5,000,000; the current costs for the registration process is MUR50,000 + 1400 paper cost. It is to be noted that this fee may be subject to change in line with Registrar Rules
 
(ii)    Legal Fees MUR 2,000 – for the vetting of the fixed charge document prior same is signed by you and sent for registration
 
(iii)   Search Fee MUR 400 – for the verification of the ‘casier hypothécaire’ of the property being purchased; current proprietor; whether the property is burdened by any existing lien/privilege etc..
 
(iv)  MCIB Fee MUR 100 – to check both your local credit history and current credit profile (this is a legal requirement under the Macro-Prudential Rules attached)          
 
(v)    Handling Fee 1% of loan value – fees represent banking service from application to disbursement of the facility into account
 
(vi)  Monthly Ledger Fee MUR 75+VAT – will be levied on a monthly basis until full reimbursement of the loan.
 
(vii) Life Assurance assigned to the favor of Bank – As per Insurer’s Quote; cover in name of borrower against death, total & permanent disability for the full loan amount & tenor. We can help you to set up this item in Mauritius      
 
(viii) Building Insurance assigned to the favor of Bank – Against Fire, Flood & Cyclone for the full replacement cost of the Legend Hill Villa/Apartment after they would have been delivered to you by the Promoter
 
(ix)  Term Deposit – Evidence that the borrower has credited at least 3 monthly installments in a non-withdrawal account which will be assigned to the favor of Bank until full loan repayment
 
(x)    Undertaking letter of the borrower to credit at least 120% of the monthly loan installment on a monthly basis in your bank account with us
 
(xi)  Evidence of the borrower’s own funds amounting to a minimum of 30% has been injected in the acquisition project prior disbursement of the loan facility
